# Samhain Security — Terms of Service **Effective date:** March 22, 2026 **Version:** 1.0 --- ## 1. General 1.1. These Terms of Service (the **"Terms"**) govern the relationship between you (the **"User"**) and the owner and administrator of the service under the brand **Samhain Security** (the **"Operator"**). The Operator provides the service as an **individual provider** (a single person), without specifying a corporate entity in these Terms. 1.2. The **"Service"** means the software and technical facilities, including infrastructure for a protected data transmission channel, interfaces (including the Telegram bot, website, personal account via a link from the bot), instructions and updates made available to the User under these Terms. 1.3. By using the Service (including signing up in the bot, obtaining access, making payment, redeeming a promo code, downloading configurations, or any other actual use), the User confirms that they have **read and agree** to these Terms in full. 1.4. If the User does not agree, they must **stop** using the Service. --- ## 2. Definitions **Subscription** — access to the Service for a paid or otherwise activated period. **Plan / pricing** — the price and scope of the Service as published in the bot or on the website at the time of payment. **Promo code** — a code granting discounted or trial access on the conditions stated when the code is issued. **Support ticket** — a User message in the official Service support channel (typically via the Telegram support bot), registered for review by the Operator. --- ## 3. Subject matter 3.1. The Operator provides the User with the **technical ability** to use a protected data transmission channel and related tools to **reduce risks** of traffic interception and other cyber threats **at the level of the Service infrastructure**, within the advertised functionality. 3.2. The Service is **not** legal, tax, or other professional advice; it **does not warrant** uninterrupted operation of third-party networks, the User's devices or software, or protection against **all** threats under **all** conditions. 3.3. The Operator **does not recommend** or **encourage** the User to act in violation of applicable law. **Compliance with the laws** of the User's location, citizenship, connection jurisdiction, and any other applicable laws remains the **sole responsibility of the User**. 3.4. The Operator **is not responsible** for how the User uses the Service, including for the User's **violation** of the laws of the **Russian Federation**, other countries, or international rules. **The User bears** any consequences of such use. --- ## 4. Trial access (promo code) 4.1. To help the User assess whether the Service is suitable, the Operator may issue a **promo code with a limited duration**, including **up to 3 (three) hours** (the exact duration is stated when the code is issued). 4.2. The promo code is for **evaluation only**. Specific conditions (duration, scope, limits) are set by the Operator and communicated when the code is issued or in the activation interface. --- ## 5. Payment, subscription, refunds 5.1. Paid access is provided on a **prepaid** basis as described in the bot or on the website. 5.2. **Monetary refunds for paid periods are not provided**, except where **mandatory rules** of applicable law **explicitly** require otherwise (if such rules apply to the situation). 5.3. The User acknowledges that **free trial** access via a time-limited promo code (Section 4) is intended to **evaluate the Service before payment**. 5.4. Failure by the User to use a paid period **does not entitle** the User to a pro-rata refund, unless otherwise **expressly agreed** with the Operator in writing via a support ticket and not inconsistent with mandatory law. --- ## 6. Acceptable use and prohibitions 6.1. The User must use the Service **in good faith**, without imposing excessive load, without disrupting the infrastructure, and without using the Service for unlawful activity. 6.2. Use of the Service for **unlawful** purposes is **prohibited**, including (without limitation): distributing malware, unauthorized access to third-party systems, spam/fraud, or other conduct unlawful in any applicable jurisdiction. 6.3. The Operator may **suspend or terminate** access in case of material breach of these Terms, abuse of the Service, or to protect the infrastructure and other users, with notice through an available channel where feasible (notice is not required in cases of obvious abuse or security threats). --- ## 7. Personal data 7.1. Processing of personal data (if any) is governed by a **separate Privacy Policy** (if published) and applicable law. If no separate policy is published, the User agrees to **minimal** processing necessary to provide the Service (subscription management, payments, support). --- ## 8. Intellectual property 8.1. The Samhain Security brand, website, copy, UI design, and other materials are protected by law. The User receives a **non-exclusive** right to use the Service for personal purposes under these Terms; **copying**, **reproduction**, or **commercial use** of materials without the Operator's consent is not allowed. --- ## 9. Limitation of liability 9.1. The Service is provided **"as is"**. The Operator does not warrant uninterrupted operation, error-free operation, or that the Service will meet the User's expectations. 9.2. **In no event** shall the Operator's liability exceed the **amount actually paid** by the User for the last paid Service period, **unless** mandatory applicable law sets **different imperative** limits. 9.3. The Operator is **not liable** for indirect damages, lost profits, data loss on the User's side, or actions of payment or telecom providers. --- ## 10. Changes to the Terms 10.1. The Operator may amend these Terms by publishing a new version on the website and/or in the bot with an effective date. 10.2. Continued use after the effective date means **acceptance** of the new version. If the User disagrees, they must stop using the Service. --- ## 11. Termination 11.1. The User may stop using the Service at any time by ceasing payment and use of access. 11.2. The Operator may restrict access as set out in Section 6.3 and may discontinue the Service with advance notice where possible. --- ## 12. Claims and support 12.1. **No separate claims contact (e-mail, postal address) is provided.** All communications, including **claims**, billing questions, access, and quality issues, must be submitted **only via a support ticket** in the **official Service support channel** (typically through the Telegram support bot interface). 12.2. A claim should state the substance of the request and information sufficient to identify the account/subscription (as requested by the bot). Response time shall be reasonable depending on complexity. 12.3. Any **mandatory** pre-litigation procedure (if applicable) is deemed satisfied after submission via a ticket and receipt of the Operator's response, or after **30 (thirty) calendar days** without a response attributable to the Operator. --- ## 13. Governing law 13.1. The relationship is governed by the laws of the **Russian Federation**, unless **mandatory** rules of another state **directly** apply to certain categories of consumers. 13.2. Disputes shall be resolved in accordance with applicable rules on **jurisdiction** and venue. *Operators should confirm venue rules with counsel depending on individual entrepreneur / self-employed status and consumer-law applicability.* --- ## 14. Miscellaneous 14.1. If any provision is held invalid, the remainder remains in effect. 14.2. Failure by the Operator to enforce a breach does not waive later enforcement. --- **Samhain Security** — brand of the protected-channel service and related tools.
